Distance Sales Agreement

1. PARTIES

This Agreement has been executed by and between the parties stated below, under the terms and conditions set forth herein.

By accepting this agreement, the BUYER acknowledges in advance that if they confirm the order subject to this agreement, they are obliged to pay the price of the ordered product(s) and, if applicable, any additional charges such as shipping fees and taxes, and that they have been informed of this obligation.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the terms listed below shall have the following meanings:

  1. MINISTER: The Minister of Customs and Trade,

  2. MINISTRY: The Ministry of Customs and Trade,

  3. LAW: Law No. 6502 on Consumer Protection,

  4. REGULATION: Regulation on Distance Contracts,

  5. SERVICE: Any consumer transaction other than providing goods, performed or committed to be performed in return for a fee or benefit,

  6. SELLER: The company that provides goods to the consumer within the scope of its commercial or professional activities, or acts on behalf of or for the account of the provider,

  7. BUYER: The natural or legal person who acquires, uses, or benefits from a product or service for non-commercial or non-professional purposes,

  8. SITE: The website owned by the SELLER,

  9. ORDERING PARTY: The natural or legal person who places an order for a product or service via the SELLER’s website,

  10. PARTIES: The SELLER and the BUYER,

  11. AGREEMENT: This agreement executed between the SELLER and the BUYER,

  12. GOODS: The movable property subject to shopping and all kinds of intangible goods prepared for use in an electronic environment such as software, audio, video, etc.

3. SUBJECT

This Agreement governs the sale and delivery of the product(s) ordered electronically by the BUYER via the SELLER’s website, whose features and sales price are listed below, in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, and it outlines the rights and obligations of the parties.

The listed and advertised prices on the website are the sales prices. These prices and offers remain valid until updated or changed. Time-limited prices remain valid until the end of the stated period.

7. PRODUCT(S) SUBJECT TO THE CONTRACT

7.1. Features
The basic characteristics (type, quantity, brand/model, color, number) of the product(s)/service(s) are published on the SELLER’s website. If a campaign is organized by the SELLER, you may review the basic features of the relevant product during the campaign. Valid until the end of the campaign period.

7.2. Prices
The listed and advertised prices on the site are the sales prices. These prices and promises remain valid until updated or changed. Time-limited prices are valid until the specified date.

7.3. Taxes and Payments
The total price of the product or service, including all taxes, is shown below.

Invoice Delivery: The invoice will be delivered to the billing address together with the order during delivery.

9. GENERAL PROVISIONS

9.1. Information and Acceptance
The BUYER acknowledges, declares, and undertakes that they have read and are informed about the basic features, price, and payment method of the product subject to the contract, and the delivery conditions as stated on the SELLER's website, and have given the necessary confirmation electronically.

9.2. Delivery Time
Each product subject to the contract shall be delivered to the BUYER within 30 days at the latest, depending on the BUYER’s location, as stated in the pre-information section of the website.

10. RIGHT OF WITHDRAWAL

In the case of a distance contract related to the sale of goods, the BUYER may exercise the right to withdraw from the contract within 14 days from the delivery of the product to the BUYER or to the person/institution at the specified address, without giving any reason and without any obligation.

11. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

Products that are prepared in accordance with the BUYER’s request or explicitly for their personal needs, such as underwear bottoms, cosmetics, single-use items, etc., are excluded from the scope of the right of withdrawal.

12. DEFAULT AND LEGAL CONSEQUENCES

In the event the BUYER defaults in credit card payments, they agree, declare, and undertake to pay interest under the credit card agreement with their bank and to be liable to the bank.

13. COMPETENT COURT

In case of disputes arising from this contract, complaints and objections may be submitted to the consumer arbitration committee or the consumer court at the place where the consumer resides or where the transaction was carried out.

14. ENFORCEMENT

By making the payment for the order placed through the Site, the BUYER is deemed to have accepted all the terms of this Agreement.

15. APPENDIX

  The BUYER declares and acknowledges that all rights arising from the Law on Intellectual and Artistic Works (FSEK) regarding the design techniques, textures, patterns, drawings, design elements (icons, buttons, etc.), styles, gradient and solid color tones, graphic design, illustrations, and other artistic components used in the design of the products produced by the SELLER and offered for sale on the website belong to the SELLER.

  All information and content on the website, including their arrangement, modification, and use, unless otherwise agreed by the SELLER, and except for third-party content, are protected by intellectual and industrial property rights and are owned by the SELLER. Products purchased by the BUYER, in whole or in part, or any data, software, or service obtained from the product may not be altered, copied, distributed, reproduced, published, used to create derivative works, transferred, or sold. The BUYER agrees and undertakes not to use the product purchased under this Agreement for illegal purposes and/or in prohibited ways. Otherwise, the BUYER will be solely responsible for all legal and criminal liabilities, and the SELLER reserves the right to claim all kinds of compensation and other legal remedies against unauthorized use.
